The website www.all-captaincause.com (hereinafter the "Platform") is a donation platform, published by RespUp SAS, a company with capital of 22,800.82 euros, whose registered office is located at 42 rue de Maubeuge 75009 Paris, registered under number 909 928 111 with the Paris Trade and Companies Register (hereinafter "Captain Cause").

The Platform is used by ACCOR SA (hereinafter "Accor"), a public limited company, whose registered office is located at 82 rue Henri Farman - CS 20077 - 92445 Issy les Moulineaux Cedex- France, registered under number B 602 036 444 with the Nanterre Trade and Companies Register, as part of its loyalty program.

Captain Cause is a company that has developed a citizen support platform for responsible projects. Its aim is to promote the financing of projects with a strong social or environmental impact. These projects can be led by commercial companies or non-profit organizations. Captain Cause offers services that enable corporate sponsors to donate and release funds for impact projects, based on the votes of various users (employees, suppliers, customers and others).

1. PURPOSE

These General Terms and Conditions of Use ("hereinafter "GTC") determine the conditions under which users may access and use the Platform.

This document is a contract between the user of the Platform (hereinafter "You" or "User") and Accor, hereinafter referred to separately as "Party" and together as "Party".

Access to the Platform is subject to the User's compliance with the GCU. Consequently, by browsing the Platform, the User is deemed to have accepted the Terms and Conditions of Use.

When the User ticks the box stating "I accept the Platform's T&Cs and Privacy Policy", he/she confirms that he/she accepts the T&Cs without restriction.

2. DEFINITION

For the purposes of this Agreement, the following terms shall have the meanings set forth below:

• Association: means any foundation, non-profit association governed by the law of July 1, 1901, or any endowment fund.
• Donation: means any Reward point donated by ALL Members to an association via the Platform or donated by Accor to an association chosen by ALL Members as part of special operations carried out on the Platform.
• Accor Personal Data: refers to all data held by Accor which allows, directly or indirectly, the identification of a natural person, which Accor or Captain Cause keeps in their system, application or database and which could be accessed, used or kept for the purpose of making Donations on the Platform.
• Accor Data: refers to all data belonging to or used by Accor and made accessible to Captain Cause for the purpose of making Donations on the Platform.
• Personal Space: refers to the User's personal space (or account) on the Platform, accessible by the User through the use of his/her ALL credentials.
• Captain Cause Endowment Fund:** means the endowment fund under French law, a non-profit organization of which Captain Cause is a founding member, and which acts in the public interest.
• ALL Member: refers to any customer enrolled in the Accor Live Limitless loyalty program.
• Amount: means any cash amount collected via the Platform from Users or Accor with a view to supporting and financing one or more Projects proposed on the Platform.
