The site www.captaincause.com (hereinafter the “Platform”) is published by RespUp SAS, a company with a capital of 22,500 euros, whose head office is located at 42 rue de Maubeuge 75009 Paris, registered under number 909 928 111 with the Paris RCS (hereinafter the “Company” or “Captain Cause” or "*We *").
We are a citizen support platform for responsible projects. Our objective is to promote the financing of projects with a strong social or environmental impact, in France or in the European Economic Area. These projects can be led by commercial companies or non-profit organizations. We thus offer services allowing corporate patrons and sponsors to donate and release funds that will be allocated to impact projects, based on the votes of different users (employees, suppliers, customers or others).
- OBJECT
These General Conditions of Use (“hereinafter “GCU”) determine the conditions under which users can access and use the Platform.
This document is a contract concluded between the user of the Platform (hereinafter “You” or “User”) and the Company, hereinafter separately referred to as “Party” and together “Parts”.
Access to the Platform is subject to compliance with the Terms by the User. Consequently, by browsing the Platform, the User is deemed to have accepted the General Conditions of Use.
When a User ticks the box indicating “I accept the Terms and Conditions and the Privacy Policy of the Platform”, he confirms that he accepts the Terms and Conditions without restriction.
- DEFINITION
For the purposes of this contract, the following terms shall have the definition given below:
- Association: refers to any foundation, non-profit association under the law of July 1, 1901, or any endowment fund.
- Captain Cause Endowment Fund: refers to the endowment fund governed by French law, a non-profit organization of which the Company is the founding member, and which acts in favor of the general interest.
- Campaign: designates the period during which a Sponsor or Patron offers Voters of his choice to vote for one or more Projects he has pre-selected.
- Amount: refers to any sum in cash collected through the Platform from Patrons and Sponsors with a view to supporting and financing one or more Projects proposed on the Platform.
- Personal Space: refers to the User’s personal space (or account) on the Platform, accessible by the User by means of the use of his identifiers.
- Sponsor: refers to any legal person who enters into a contract with the Captain Cause Endowment Fund with a view to carrying out a sponsorship operation for its exclusive benefit.
- Beneficiary Organization(s): means any organization (Association, commercial company, company benefiting from approval or label) carrying Projects on the Platform and being able to benefit from Amounts.
- Preselected(born): designates the Projects pre-selected by a Sponsor or Patron (approximately between 3 to 9 Projects) from a catalog of several dozen Projects, in order to then submit them to the vote.
- Project(s) or Impact Project(s): refers to one or more projects carried out by an Association or a commercial company and which will be carried out with the support of the Amounts collected through the Platforms from Patrons and Sponsors.
